AG sues owner of faulty Taunton dams

Lawsuit requests immediate repairs at two lake sites

The attotney generals office has filed a lawsuit against the owner of 2 dams in Tauton that have

been declared structurally unsound; the damage are deemed to be so unsound that they trigger

worries of massive floods whenever heavy rainfall occurs. The lawsuit has been filed in Suffolk

Court requesting that immediate repairs are made by the owner (Jefferson Development Partners)

of Morey's Bridge Dam and a cofferdam which are assist in holding backs the water of the 250

acres Lake Sabbatia off Bay Street.

The same company owned the former Whittenton Pond Dam that officials feared mights collapse

in 2005, forcing the evacuation of some 2,000 residents who were downstream from the

deteriorating structure and who were threatened by flooding. That dam has since been replaced.

There are concerns of flooding should a breach occur.

"We do have an issue of public safety that is still in the balance here," said state Senator

Marc R. Pacheco, a Democrat from Taunton who has lobbied for more funding for dam repairs

since 2005. "It's been years and we still have not seen the right outcome here."

The cofferdam was built in July 2007 as a temporary replacement for the Morey's Bridge Dam,

which is in need of structural repairs. A group of volunteers called Help Save the Lake assisted

in the construction of the cofferdam to stabilize water levels in Lake Sabbatia and to relieve

pressure on Morey's Bridge Dam, a 12-foot-high, 130-foot-long structure that had breaches

and allowed the lake levels to drop.
